Terms of Service

1. Acceptance and scope
These Terms govern use of the Topiarly website and the Topiarly Chrome extension, including conversation selection, search, archiving, unarchiving, and deletion. “Topiarly,” “we,” and “us” refer to the individual operator of Topiarly; contact details appear in section 20. “You” means the person using the service, or the organization that person is authorized to represent.
You must have a reasonable opportunity to read and retain these Terms before accepting them. Any express consent required by law must be obtained separately. Merely visiting this page does not constitute acceptance. Additional paid-service conditions, if introduced, will be disclosed before you agree to them and will not override mandatory protections.
2. Independent product
Topiarly is an independent product. It is not affiliated with, sponsored by, or endorsed by OpenAI. ChatGPT and OpenAI names and marks belong to their respective owners. References to them identify the platform with which Topiarly works and do not imply an official relationship.
3. Your authorization and account access
Use Topiarly only with an account and conversations you are entitled to access and manage. If you act for an organization or another person, you must have authority for the actions you request. Follow applicable laws and any valid obligations concerning records, confidentiality, retention, or third-party rights.
You are responsible for choosing the conversations and action, checking the signed-in account and selected conversation count, reviewing the complete selection, and preserving important information before confirming deletion. Do not confirm an action unless you understand and intend its consequences. Topiarly acts on your selections; it does not independently decide which conversations to delete.
Clicking Delete and completing the deletion confirmation constitutes your explicit authorization to permanently delete the selected conversations. That authorization is limited to the selection and action you confirm. Responsibility for correctly executed, authorized deletion and the limits of that responsibility are set out in sections 5 and 14.
4. Bulk conversation management
Topiarly helps you load conversation metadata, search loaded conversation titles, select conversations, and request archive, unarchive, or delete actions through your existing signed-in ChatGPT session. A loaded or filtered list may not represent all conversations in your account. Review the actual selection rather than assuming that a search or bulk-selection control has identified only the chats you intend to manage.
A bulk request may involve separate operations for individual conversations. It is not a promise of an all-or-nothing transaction or an automatic rollback if an operation fails.
5. Permanent deletion and recovery
Deleting conversations is permanent and cannot be undone through Topiarly. Permanent deletion may be irreversible, including through the third-party platform. Uninstalling Topiarly does not reverse operations already sent to ChatGPT.
Topiarly provides no backup or recovery service and does not maintain a recoverable copy of deleted conversations. No recovery by OpenAI or another third party is promised. Before confirming deletion, preserve any information you need using a suitable independent method and verify that your copy is usable.
You are responsible for the consequences of deletion operations you knowingly select, authorize, and confirm, provided Topiarly executes those operations correctly. This includes the intended permanent removal of the selected conversations and resulting loss of access to their content. A mistaken selection, failure to preserve information, or later change of mind does not by itself make a correctly executed operation defective or create an obligation to restore content or compensate you, subject to mandatory law.
This allocation of responsibility does not treat deletion caused by a software defect, deletion outside your confirmed selection, or an unauthorized operation as correctly executed user-authorized deletion. The limitations and mandatory protections in sections 14 and 15 apply.
6. Archiving is different from deletion
Archiving removes a conversation from the active list while keeping it available in the archived view. Archived conversations can be restored by unarchiving, subject to the conversation remaining available on ChatGPT. Unarchiving does not recover a deleted conversation. Choose archive when you want to keep a chat for possible later use; deleting an archived chat is still permanent through Topiarly.
7. Technical errors and partial operations
Network interruptions, authentication problems, platform restrictions, browser behavior, or software errors can prevent an action, interrupt a batch, or leave its result unclear. Some conversations may be processed while others remain unchanged. A timeout or missing response does not by itself establish whether an action completed.
If the outcome is uncertain, stop and check the affected conversations in ChatGPT before repeating a destructive action. Contact support with the action, approximate time, and any visible error. Do not send passwords, session tokens, or private conversation content. The allocation of risk and mandatory exceptions in sections 14 and 15 apply to these situations.
8. Third-party dependencies and compatibility
Topiarly depends on Chrome, the Chrome Web Store, ChatGPT, your internet connection, and your existing platform account. Their providers have their own terms, policies, availability, and account restrictions. Topiarly cannot grant rights to use those services or guarantee their availability.
Changes to ChatGPT interfaces, endpoints, authentication, rate limits, or browser requirements may affect functionality. Compatibility with every platform update, browser version, or account configuration is not guaranteed. Topiarly is intended for desktop Chrome; mobile installation is not supported. The limitations and mandatory protections in sections 14 and 15 apply.
9. Privacy and security
The Privacy Policy describes the extension’s current data handling, including conversation metadata, session authentication, page-memory storage, and optional support or uninstall feedback. Topiarly uses your existing ChatGPT session for the actions you request. These Terms do not authorize additional collection or use of personal data.
Protect your device and account, use a trusted extension source, and avoid sharing authentication information. No software can promise absolute security. The operator remains responsible for applicable privacy, security, and breach-response duties. Security and privacy notices will be updated before materially different data practices are introduced, and any legally required consent will be requested separately.
10. Intellectual property
Rights in Topiarly’s software, original website content, and branding belong to the operator or their licensors. Subject to applicable law and any separate open-source license, you may use the extension and website for their intended purposes. No ownership of Topiarly is transferred to you.
You retain any rights you have in your conversations. Topiarly does not acquire ownership of them by processing a requested action. Third-party marks and licensed materials remain subject to their owners’ rights. Nothing here restricts statutory rights to interoperability, permitted reverse engineering, quotation, or other uses that cannot lawfully be prohibited.
11. Acceptable use
Do not use Topiarly to access or delete another person’s data without authorization, evade lawful access controls, distribute malware, interfere with service security, infringe intellectual property or privacy rights, or carry out unlawful activity. Do not misrepresent Topiarly as an official OpenAI product.
Where misuse creates a security or legal risk, access to services under the operator’s control may be restricted proportionately and with notice where practicable and lawful. This does not authorize the operator to delete your conversations as a penalty or limit any mandatory rights you have.
12. Availability, updates, and stopping use
Topiarly is currently free. Features may be maintained, corrected, updated, or discontinued for legitimate technical, security, legal, or operational reasons. Continuous or error-free availability and indefinite support for every version are not promised. Applicable duties to provide conformity remedies or necessary updates remain unaffected.
Material adverse changes will be explained with appropriate notice and choices where required by law. An update is not permission for unrequested conversation actions. You may stop using Topiarly and uninstall it; this does not undo completed archive, unarchive, or delete operations.
13. Warranty disclaimers
To the maximum extent permitted by applicable law, Topiarly is provided on an “as is” and “as available” basis, without additional express or implied warranties, including warranties of merchantability, fitness for a particular purpose, or compatibility. Topiarly and its individual operator do not voluntarily guarantee uninterrupted, timely, secure, or error-free operation, continued availability, compatibility with future platform changes, or backup or recovery of content.
These disclaimers are subject to any express commitment separately agreed with you and the mandatory protections in sections 14 and 15. They do not override applicable statutory requirements of conformity, security, or remedies for defective performance. No statement in these Terms creates a voluntary guarantee beyond those commitments or applicable legal requirements.
14. Responsibility and limitations of liability
To the maximum extent permitted by applicable law, neither Topiarly nor its individual operator is liable for the intended removal of conversations or loss of access to their content resulting from deletion that you knowingly selected, authorized, and confirmed and that Topiarly executed correctly. You bear those consequences, including where you selected the wrong conversations, failed to preserve information, or subsequently regret the decision. This exclusion concerns the intended result of correct execution, not deletion caused by a software defect or an unauthorized operation.
To the maximum extent permitted by applicable law, neither Topiarly nor its operator is liable for losses caused by third-party platform changes, restrictions, account actions, outages, or failures; interruptions to networks or services outside the operator’s reasonable control; or unavailable or discontinued functionality, except to the extent that the operator is legally responsible for the loss. No continuous access, future compatibility, or recovery obligation is assumed beyond applicable legal requirements and separately agreed express commitments.
For users acting in a business or professional capacity, and only to the extent permitted by law, liability is limited to losses legally attributable to the operator and reasonably foreseeable in the circumstances; indirect or consequential business losses, loss of profit, revenue, business opportunity, or goodwill are excluded. These business-use limitations do not restrict a consumer’s mandatory remedies.
Mandatory exceptions: Nothing in these Terms excludes or limits liability to the extent that applicable law prohibits doing so, including liability for fraud, deliberate wrongdoing, gross negligence, death or personal injury, breaches of mandatory consumer or data-protection rights, defective performance, or unauthorized operations. Confirmation is not consent to deletion outside the confirmed selection or a waiver of non-excludable rights concerning software defects. Where a limitation cannot lawfully apply, responsibility and remedies are determined by applicable law. No zero-value or fee-based liability cap is imposed merely because Topiarly is free.
15. Consumer rights and mandatory protections
If you are a consumer, you retain all protections that apply to you, including applicable rights concerning digital content and services, conformity, necessary updates, remedies, fair contract terms, and access to courts or public authorities. If paid services are later offered, applicable pre-contract information, cancellation, withdrawal, refund, and subscription protections will also apply.
These Terms do not require you to waive a mandatory right, accept a remedy narrower than the law provides, or bear an unfair burden of proof. If a clause is unenforceable, it will not bind you; the rest applies only insofar as it can lawfully continue without reducing those protections.
16. Possible future monetization
Topiarly may consider optional Pro features, subscriptions, advertising, or affiliate links in the future. This is not an announcement that any such feature is currently available, and these Terms do not authorize charges or new data uses. Advertising or affiliate arrangements, if introduced, will be clearly identified where required and will not automatically authorize access to your conversation data.
No payment or subscription may be imposed merely because you install, use, or previously used the free extension. Before any paid purchase, you must receive clear information about the service, total price and applicable taxes, billing frequency, renewal, duration, cancellation, and withdrawal or refund rights, and expressly agree to the purchase and any recurring charges. Silence, inactivity, or acceptance of general Terms is not consent to a charge.
Future business models must be assessed against applicable law, Chrome Web Store requirements, and the Privacy Policy. Any necessary privacy notices, data choices, consents, and additional purchase terms must be implemented before the relevant feature launches. Future possibilities described here do not change the current policy’s restrictions on advertising use of data.
17. Complaints and support
For help or a complaint, contact adamzar.helpdesk@outlook.com or visit Support. Describe the issue and requested resolution without disclosing private conversation content or authentication information. Support and uninstall feedback are optional; sending an email is a separate action you review and initiate.
We will consider complaints and respond within any period required by applicable law. Contacting support is not a compulsory step before exercising rights to complain to a competent authority or seek a court remedy. No compulsory arbitration, exclusive private complaint service, or restriction on statutory complaint channels is imposed.
18. Changes to these Terms
These Terms may be revised for legitimate changes to the product, applicable law, or business model. The revised document will identify its date and explain material changes with appropriate advance notice where required. Changes will not retrospectively authorize earlier actions, charges, or data uses, or remove rights already accrued.
Where a change requires new agreement, payment authorization, or privacy consent, it will be requested separately. Continuing to use the service is not a substitute for legally required express consent. You may stop using the service if you do not accept a future change, without losing mandatory remedies.
19. Governing Law and Disputes
These Terms are governed by Spanish law, except where mandatory laws provide otherwise.
Any disputes relating to Topiarly will be handled by the courts having jurisdiction under applicable law.
Nothing in this section limits any mandatory consumer rights or legal protections.
